2 Intellectual Property Rights
1 Introduction
KulturCart is committed to respecting and protecting the intellectual property rights of all parties involved in our online marketplace. This Seller Intellectual Property Policy (the "Policy") outlines the rules and guidelines that all sellers ("Vendors") must follow to ensure the lawful use and protection of intellectual property rights on the KulturCart platform. By using the KulturCart marketplace, Vendors agree to abide by this Policy and acknowledge that failure to do so may result in the suspension or termination of their account.
2 Intellectual Property Rights
Intellectual Property Rights include but are not limited to, copyrights, trademarks, patents, design rights, trade secrets, and other proprietary rights. Vendors are solely responsible for ensuring that they have the necessary rights, licenses, and permissions to sell their products and use any intellectual property associated with those products on KulturCart.
3 Prohibited Conduct
Vendors must not engage in any of the following activities:
- Infringement: Selling, promoting, or otherwise using products that infringe upon the intellectual property rights of any third party, including counterfeit or unauthorized items.
- Unauthorized Use: Using any logos, trademarks, or copyrighted material without express written consent from the respective rights holder.
- False Representation: Misrepresenting the origin, authenticity, or other characteristics of a product to deceive customers or infringe upon the intellectual property rights of third parties.
- Unauthorized Copying: Copying, reproducing, or distributing copyrighted content, such as product descriptions, images, or reviews, without the express written consent of the rights holder.
4 Reporting Infringement
If any party believes that their intellectual property right has been infringed upon by a Vendor on the KulturCart marketplace, they may report the infringement by contacting our Intellectual Property Rights team at [recht@kulturcart.de]. We will investigate the claim and take appropriate action, which may include removing the infringing content and/or suspending or terminating the Vendor's account.
5 Vendor's Responsibilities
Vendors are responsible for:
- Ensuring that they have the necessary rights, licenses, and permissions to sell their products and use any associated intellectual property on the KulturCart marketplace.
- Regularly reviewing and updating their product listings to ensure that they are accurate, current, and do not infringe upon any third-party intellectual property right.
- Cooperating with KulturCart in the investigation and resolution of any intellectual property right claims, including providing any requested documentation and information.
- Indemnifying KulturCart and its affiliates, officers, directors, employees, and agents against any claims, damages, losses, or expenses (including legal fees) arising from any breach of this Policy.
6 Consequences of Violation
Violation of this Policy may result in a range of actions, including but not limited to:
- Removal of infringing content or product listings.
- Suspension or termination of the Vendor's account.
- Legal action against the Vendor, including claims for damages and indemnification.
7 Modifications to the Policy
KulturCart reserves the right to modify this Policy at any time without prior notice. Vendors are responsible for regularly reviewing the Policy to ensure compliance. Continued use of the KulturCart platform constitutes acceptance of any modifications to the Policy.
